Before filing any arbitration demand or legal claim, you agree to first contact us at contact@hawaiisbesttravel.com and make a good-faith effort to resolve the dispute informally for at least 30 days.

If the dispute is not resolved informally, you and Hawaii’s Best agree that any dispute, claim, or controversy arising out of or relating to these Terms, your use of the website, our content, products, services, consultations, or any other matter involving Hawaii’s Best, will be resolved exclusively by final and binding arbitration — not in court — except as described below.

Arbitration Rules. Arbitration will be administered by JAMS under its Streamlined Arbitration Rules and Procedures (for claims of $250,000 or less) or its Comprehensive Arbitration Rules and Procedures (for larger claims), as applicable, and as modified by these Terms. The JAMS rules are available at jamsadr.com. The arbitrator will apply California substantive law.

Location. Arbitration will be conducted in Los Angeles, California, or — at your election — by telephone, video conference, or written submissions.

Costs. JAMS filing and administration fees will be paid as required by JAMS rules. For claims of $10,000 or less brought by you, we will pay the JAMS filing fee and arbitrator’s compensation.

Award. The arbitrator may award any relief available in court on an individual basis. The arbitrator’s decision will be final and binding. Judgment on the award may be entered in any court of competent jurisdiction.

Exceptions. Either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction solely to prevent irreparable harm pending arbitration. Claims that qualify for small claims court may be brought in small claims court in lieu of arbitration.

Opt-Out. If you do not wish to be bound by this arbitration agreement, you must notify us in writing within 30 days of first agreeing to these Terms by emailing contact@hawaiisbesttravel.com with the subject line “Arbitration Opt-Out.” If you opt out, disputes will be resolved in the courts described below, but the No Class Actions provision (Section 29) will still apply to the fullest extent permitted by law.

If this arbitration agreement is found unenforceable for any reason with respect to a particular dispute, that dispute will be resolved in the state or federal courts located in California, and you consent to the personal jurisdiction and venue of those courts.


29. No Class Actions

Arbitration under Section 28 will be conducted on an individual basis only.

To the fullest extent permitted by law, you agree that any dispute with Hawaii’s Best must be resolved individually and not as part of any class action, collective action, private attorney general action, or representative proceeding. The arbitrator may not consolidate more than one person’s claims or otherwise preside over any form of representative, class, or collective proceeding.

If the class action waiver in this section is found unenforceable — for example, with respect to claims that cannot be waived under applicable law — then the arbitration agreement in Section 28 will also not apply to those claims, which will instead be resolved in the courts described in Section 28. All other claims will remain subject to arbitration on an individual basis.


30. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect.

The invalid or unenforceable provision will be modified or interpreted to the extent necessary to make it enforceable, if permitted by law.


31. No Waiver
